使用条款Terms of Use

本使用条款构成你与 上海修昔底德科技有限公司（以下简称“公司”或“我们”）之间关于 Momo 的协议。

下载、安装或使用 Momo 翻译 / Momo.tr（“Momo”或“App”），即表示你同意本使用条款和我们的隐私政策。如果你不同意，请不要使用并卸载 App。

如果你未达到所在地区独立订立有效协议所要求的年龄，应由父母或法定监护人代表你阅读并同意这些条款。

These Terms of Use form an agreement between you and Shanghai Thucydides Technology Co., Ltd. (the “Company,” “we,” “us,” or “our”) regarding Momo.

By downloading, installing, or using Momo Translation / Momo.tr (“Momo” or the “App”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the App and uninstall it.

If you are not old enough to enter a valid agreement in your location, a parent or legal guardian must review and agree to these Terms for you.

在你遵守本条款的前提下，公司授予你一项有限、非独占、不可转让、不可再许可、可撤销的许可，允许你在自己拥有或控制的兼容设备上，将 Momo 用于个人或内部业务目的。

App 及其界面、品牌、文案与由公司提供的原创内容受适用知识产权法律保护。App 中的开源软件、模型和第三方组件适用各自的许可证；当这些许可证与本条款冲突时，就对应组件而言以其许可证为准。

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Momo for personal or internal business purposes on compatible devices you own or control.

The App and its interface, branding, copy, and original content supplied by the Company are protected by applicable intellectual property laws. Open-source software, models, and third-party components are governed by their own licenses. If those licenses conflict with these Terms, their terms control for the relevant component.

你应合法、负责地使用 Momo，并对你输入、录制、翻译、保存或分享的内容负责。除非法律明确允许，你不得：

• 使用 App 侵犯他人的隐私、保密、著作权或其他权利；
• 在未经授权的情况下录制他人，或违反当地关于同意、录音和监听的法律；
• 利用 App 从事违法、欺诈、有害、骚扰或滥用活动；
• 规避安全措施，恶意干扰 App，或分发恶意代码；
• 移除权利声明，或以违反适用许可证的方式复制、修改、反向工程或再分发 App 的受保护部分。

You must use Momo lawfully and responsibly, and you are responsible for content you enter, record, translate, store, or share. Unless applicable law expressly permits it, you may not:

• use the App to violate another person’s privacy, confidentiality, copyright, or other rights;
• record another person without authorization or violate local consent, recording, or interception laws;
• use the App for unlawful, fraudulent, harmful, harassing, or abusive activity;
• circumvent security measures, maliciously interfere with the App, or distribute malicious code; or
• remove rights notices or copy, modify, reverse engineer, or redistribute protected parts of the App contrary to applicable licenses.

Momo 的基础安装包不包含全部语音和翻译模型。你需要联网下载相应模型，模型文件可能较大，并可能产生网络运营商流量费用。你应确保设备有足够存储空间并符合兼容性要求。

模型文件可能通过 ModelScope 等第三方分发服务提供，并受对应模型和服务条款约束。第三方服务的可用性、速度和条款不由公司控制。有关下载请求的数据处理，请阅读我们的隐私政策。

Momo’s base installation does not include every speech and translation model. You must connect to download the relevant models. Model files may be large and may incur carrier data charges. You are responsible for having sufficient storage and a compatible device.

Model files may be supplied through third-party distribution services such as ModelScope and are subject to the relevant model and service terms. The Company does not control third-party availability, speed, or terms. See our Privacy Policy for information about download requests.

语言模型会受到口音、噪声、上下文、专业术语、设备性能和所选模型等因素影响。Momo 不能替代专业译员，也不应作为医疗、法律、财务、安全、紧急服务或其他高风险决定的唯一依据。紧急情况下，请直接联系当地紧急服务或合格专业人员。

Language models are affected by accents, noise, context, terminology, device performance, and the selected model. Momo is not a substitute for a professional interpreter and should not be the sole basis for medical, legal, financial, safety, emergency, or other high-risk decisions. In an emergency, contact local emergency services or a qualified professional directly.

在你与公司之间，你保留对自己输入、录音、转录和译文享有的权利。Momo 在设备本地处理这些内容，不会因提供离线翻译功能而要求你将内容许可给公司。

你负责保护设备、备份需要保留的内容，并在出售、转让或共享设备前清除敏感信息。卸载、系统清理、设备故障或模型更新可能导致本地数据丢失。

As between you and the Company, you retain your rights in your inputs, recordings, transcripts, and translations. Momo processes this content locally and does not require you to license it to the Company in order to provide offline translation.

You are responsible for securing your device, backing up content you need, and removing sensitive information before selling, transferring, or sharing the device. Uninstallation, system cleanup, device failure, or model updates may result in loss of local data.

我们可能发布更新，增加、修改或移除功能、模型或设备支持，以改善性能、安全性或合规性。我们不保证 App、特定模型或第三方下载源始终可用，也不保证旧版本能持续兼容未来的操作系统。

你可以随时停止使用并卸载 App。如果你严重违反本条款，我们可以在适用法律允许的范围内终止所授许可。终止后，按其性质应继续有效的条款仍然有效。

We may release updates that add, change, or remove features, models, or device support to improve performance, security, or compliance. We do not guarantee that the App, a particular model, or a third-party download source will always remain available, or that older versions will remain compatible with future operating systems.

You may stop using and uninstall the App at any time. If you materially breach these Terms, we may terminate the license to the extent permitted by law. Provisions that by their nature should survive termination will continue to apply.

在适用法律允许的最大范围内，Momo、模型和相关材料按“现状”和“可用”状态提供。公司不作任何明示、默示或法定保证，包括对适销性、特定用途适用性、所有权、不侵权、持续可用或无错误的保证。

部分司法辖区不允许排除某些保证，因此上述排除可能不完全适用于你。本条款不影响你依法不得放弃的消费者权利。

To the maximum extent permitted by applicable law, Momo, its models, and related materials are provided “as is” and “as available.” The Company disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, continuous availability, and error-free operation.

Some jurisdictions do not allow the exclusion of certain warranties, so these exclusions may not fully apply to you. These Terms do not affect consumer rights that cannot lawfully be waived.

在适用法律允许的最大范围内，公司不对因使用或无法使用 Momo 而产生的间接、偶然、特殊、惩罚性、示范性或后果性损失，或数据、利润、业务机会或商誉损失负责，即使我们已被告知可能发生此类损失。

本条款中的任何内容都不排除或限制法律禁止排除或限制的责任，包括因故意不当行为产生的责任，或适用法律规定不得限制的人身伤害责任。

To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, or for loss of data, profits, business opportunity, or goodwill, arising from your use of or inability to use Momo, even if we have been advised that such loss may occur.

Nothing in these Terms excludes or limits liability where doing so is prohibited by law, including liability for intentional misconduct or personal injury that applicable law does not permit to be limited.

应用商店条款：如果你从 Apple App Store 下载 Momo，你还须遵守 Apple 的适用许可条款；如果从 Google Play 下载，你还须遵守 Google Play 的适用条款。应用商店不是本条款下 App 支持服务的提供方。

可分割性：若本条款任何部分被认定不可执行，其余部分仍保持有效，并在法律允许范围内尽量实现原条款目的。

不放弃权利：我们未立即执行某项条款不代表放弃该权利。

条款更新：我们可能因 App 或法律要求变化而更新本条款。新版本会发布在本页面并更新生效日期。你在新条款生效后继续使用 App，即表示接受更新；如不同意，应停止使用。

适用法律：本条款受适用法律管辖，同时保留你所在地区依法享有的强制性消费者保护权利。

App store terms: If you download Momo from the Apple App Store, Apple’s applicable license terms also apply. If you download it from Google Play, Google Play’s applicable terms also apply. The app store is not the provider of App support under these Terms.

Severability: If any part of these Terms is held unenforceable, the remaining terms remain in effect, and the affected term will be applied as closely as legally possible to its original intent.

No waiver: A delay in enforcing a provision does not waive our right to enforce it later.

Changes to these Terms: We may update these Terms when the App or legal requirements change. A new version will be posted here with a revised effective date. If you continue using the App after updated Terms take effect, you accept them. If you do not agree, stop using the App.

Applicable law: These Terms are governed by applicable law, while preserving any mandatory consumer protections you have in your place of residence.
